Terms of Service

Open items the owner has not yet resolved — flagged inline as [COUNSEL REVIEW: …]. The “COUNSEL REVIEW” string is retained for future search-replace; for now the owner is the one resolving them.

These Terms govern your use of the carspottone app and website (the “Service”), provided by [COUNSEL REVIEW: legal entity name and registered office] (“we”, “us”).

1. Acceptance

By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What carspottone is

You spot a real car in public and photograph it. AI identifies the car and turns it into a card. The card’s stats come from real specs, and its rarity comes from production numbers. You build decks and race other players in duels. Some items are free and some are paid.

3. Eligibility

  • You must be at least 18 years old. You confirm you are 18 when you sign up.
  • If we learn that an account belongs to someone under 18, we close it and delete its data.
  • You must not be barred from receiving the Service under the laws of any jurisdiction that applies to you, and you must not have been previously banned from the Service.

4. Your account

  • One account per person. Sharing accounts is not allowed.
  • You are responsible for keeping your sign-in credentials secure. Tell us immediately if you suspect your account has been compromised.
  • Automation, bots, scripts, emulators, modified clients, and any other tooling that interacts with the Service without going through the official UI are prohibited.

5. Photo rules

carspottone is built around photographs you have personally taken of cars in public. When you upload a photo:

  • You must own the copyright in the photo. Do not upload images you did not personally capture.
  • Do not upload manufacturer press photos, marketing imagery, screenshots, or any third-party copyrighted material. User-captured photographs only.
  • Do not upload photos that show identifiable faces of other people without their consent. Plates and faces are detected automatically and blurred. Detection can miss, for example with unusual plates, low light, or odd angles. Check the photo before you save it. If you save a photo where something was missed, you are responsible for it.
  • No offensive content. Photos must depict a real road-going or competition vehicle. Sexual content, hate symbols, gore, illegal acts, and anything designed to harass or shock are prohibited.
  • No location bait. Do not deliberately upload photos taken at private addresses you do not own (e.g. someone’s driveway).
  • Stay on public ground. Do not photograph or film on private property without permission.

6. Intellectual property

6.1 Your photos

You keep ownership of every photo you upload. By uploading a photo, you grant us a worldwide, non-exclusive, royalty-free licence to host the photo, generate a card from it, display it within the Service to you and your opponents, and use it for the operational purposes of the Service (anti-cheat, moderation, customer support). The licence ends when you delete the card and the photo is removed from storage in line with the Privacy Policy.

This licence also lets us use your uploaded car photos to (a) illustrate the shared “pay-to-win” pool cards that other players can receive in packs, and (b) train and improve car-recognition AI models. You can opt out of both of these uses at any time in Settings; opting out applies going forward and does not remove photos already incorporated into a shared card.

We will not use your photos in advertising or marketing without separate, opt-in consent.

6.2 Car brand references

carspottone uses make and model names (e.g. “Ferrari 488 GTB”) only as plain text descriptions of the vehicle in your photo. This is a nominative reference — we are identifying a real-world vehicle, not implying endorsement, sponsorship, or licensing by any manufacturer. We do not use manufacturer logos, badges, wordmarks, marketing imagery, or AI-generated brand art anywhere in the Service. See our IP framework in plans/RESEARCH.md for the underlying analysis [COUNSEL REVIEW: confirm nominative-use framing for each launch jurisdiction].

6.3 Our IP

The Service, including the game design, card frames, UI, code, art assets we produce, brand, and trademarks, is owned by us or our licensors. You may not copy, modify, distribute, sell, or reverse engineer any of it.

7. Paid items

You can buy these in carspottone:

  • Card packs. Random contents. They include cards you can use in duels, so paid items can affect gameplay.
  • Spot passes. Extra spot identifications.
  • Subscriptions. Billed monthly. They renew automatically.
  • We show the price before you pay.
  • All purchases, on web and on mobile, are paid through Stripe.
  • Paid items and in-game items have no cash value. You cannot transfer or sell them. They are licensed to your account.

7.1 Subscriptions

  • A subscription renews each month until you cancel it.
  • You can cancel any time from the Subscriptions page. Cancelling stops the next payment. It does not refund the current period.

7.2 Right of withdrawal (EU/EEA consumers)

  • You have 14 days from purchase to withdraw. Do it at carspottone.com/withdraw.
  • Subscriptions: if you asked for the subscription to start straight away and then withdraw, you pay only for the days you used.
  • Packs and spot passes are delivered immediately. At checkout you agree to immediate delivery and accept that you lose the right of withdrawal once they are delivered. You cannot buy without agreeing.

7.3 Everyone else

Outside the EU/EEA, we refund only where the law requires it.

8. Free rewards

  • Weekly packs, welcome packs, and scrap are free. They have no cash value and cannot be transferred or refunded.
  • We can withhold or take back rewards earned through multiple accounts, bots, exploits, or other abuse.
  • We may change free rewards.

9. Acceptable use

You must not, and must not attempt to:

  • Cheat, exploit bugs, manipulate match-making, collude in duels, or use any tool designed to gain an unfair advantage.
  • Harass, threaten, dox, impersonate, or stalk other users.
  • Post hate speech, discriminatory content, or content that incites violence.
  • Scrape, crawl, mass-download, or otherwise systematically extract data from the Service.
  • Attempt to reverse engineer the anti-cheat system or interfere with its operation.
  • Spoof your GPS or location, or tamper with photo timestamps.
  • Run multiple accounts or boosting rings to climb the leaderboard or farm rewards.
  • Send spam or ads.
  • Use the Service for any unlawful purpose.

Report content that breaks these rules with the in-app report button.

    10. Removal requests

If your car or you appear in a spot, ask for removal at /removal. We reply within 30 days. Copyright complaints and reports of illegal content go to the report page.

    11. Termination

    • You can delete your account at any time from Settings. Deletion follows the schedule described in the Privacy Policy (30-day grace period, then hard-delete).
    • We may suspend or terminate your access if you breach these Terms, abuse the Service, or where required by law. If we suspend you or remove content, we tell you why. You can appeal by replying to that email within 6 months (EU Digital Services Act).

    12. Disclaimers

    • Car identification is done by AI and can be wrong.
    • Stats and rarity are game values, for entertainment.
    • To the extent the law allows, we provide the Service “as is” and “as available”.
    • Nothing in these Terms limits your statutory rights as a consumer. In the EU, digital content must conform to the contract.

    13. Limitation of liability

    • We are fully liable for intent, gross negligence, death or personal injury, and anything that cannot be limited by law.
    • Otherwise, we are liable only for foreseeable damage.

    14. Disputes and governing law

    • Polish law governs these Terms.
    • If you are an EU consumer, you keep the mandatory protections of your own country’s law. You can sue in your home courts.
    • There is no arbitration and no class-action waiver.

    15. Reporting illegal content

If you believe content on the Service infringes your copyright or is otherwise illegal, see how to report illegal content.

    16. Changes to these Terms

We may update these Terms. For material changes, we will notify you via an in-app banner and by email at least 30 days before the change takes effect, and will give you the option to delete your account if you do not accept the change. If you are on a subscription and do not accept, you can cancel and get a pro-rata refund of the unused period. Non-material changes (typo fixes, clarifications) take effect when posted.
